Well Dave, What exactly do you need help with?
Here is my perspective.....
I would be happy to sign his petition except for a few flaws that he needs to correct.
(quoting him) My question is, since when is anybody responsible for what happens on someone else's property, except the owner of the property? These people feel that the wording of the permit makes them (police chief and sheriff) responsible absurd!
Native species of venomous snakes are common on everyone's property. Does that mean the chief and sheriff are responsible for them also?
No, they are not, however, you don't need a permit for native venomous reptiles. One thing he is not taking into consideration is this: They ARE NOT signing for the snakes, THEY ARE signing for him and his ability to safely house and maintain them. If they sign their name to this, and something happens, YES, they can face repercussions.
(quoting him)The next day the game warden calls me saying he made a mistake. He tells me the deadline to apply for a permit was in October of 2001, therefore no permits are being issued anymore and i have 30 days to get rid of my snakes!
He's lucky he got an extra 30 days. The law passed on July, 25 2001 with a 90 day grace period. Why did he wait so long?????
(quoting him)The game warden told me that even though native species of venomous snakes are legal, they have to come from Alabama only not from any other state. Native is native, no matter where it comes from. In other words, if Alabama and Florida have the same species of snake, and one was to bring that species home (Alabama) from Florida, they claim the snake would be illegal because it is from Florida, even though the same species is found in Alabama as well. I guess we need border patrol to arrest snakes that cross the border themselves. Clearly he is making up this law as he goes along. I can't see that holding up in court.
Two questions: 1. How would they know where it came from?, 2. Why ask a Game Warden when all he had to do was get online and go straight to the top....Alabama Department of Conservation and Natural Resource's website and ask the man at the very top?
(quoting him)A newspaper article, referring to the recent confiscated snakes says they were like loaded handguns laying around. The problem is loaded handguns laying around is perfectly legal!!!!
Loaded handguns will not crawl out of his home and shoot someone when he's not there. I am sick and tired of people comparing apples to oranges. I only deal with native "ALABAMA" snakes, but I have no problem whatsoever with changing the law to allow a permitting system. It just peeves me when people misstate the facts and slide under the truth to try and rally people on their side.
He should re-word his petition so that it is "Factual" and not "Misleading", and I will be happy to sign it...

I don't think you "William" has a clue what you are talking about. Did you understand the petition at all on what happened? I don't think you should be so judgmental on something when you don't even know the full story details. Take some time, read it again, ask some questions to Canebrake when you don't understand the scenario. You remind me of the other young feller who was all defensive to everyone's reply's and had webmaster stop his forum since it just ended up with people (No Names Please, lol) just bagging each other. I'm just stating my opinion, take it for what's it's worth (If you want to) It's still a somewhat free country from what I understand. Please don't start flames between people for ridiculous reasons. I will have no part of it. In that sense I will act my age. I get along with everyone in this herp trade as I believe we are all somewhat related in our work with these animals and should help out when it is needed. Sorry to take up space but It's hard when Some people try to keep this hobby clean and true.
" I wonder which state will be next in these laws????"
Thanks Herpers

Let the flaming each other stop here. Me and william Have work out our misunderstandings Through email. Sorry to all if any had to see that. I don't want enemies. Just us to work together. We are all in this for the same reasons. If anyone has questions email me first so i can explain a little better. There is so many little details involved they couldn't be put in the petition without having to write a book. Dave

hmmm....First let me say that "in theory" I agree with, and applaud you for wanting to make a difference..thats great really, I wish more people had the spirit to get involved, however, that being said I read the petition twice yesterday and I just re-read it again before this reply but I did not sign it...and heres my opinion why...I agree with William, first the whole petition sounds more like a complaining upset individual ranting...and "a lifes not fair speech". That is definately the wrong way to get changes...you must be thoughtful,in your reasoning...be very specic on how you would like to see things changed, cite the exact laws of other states such as florida and give a copy of those laws along with your petition to the Senator/Rep..with specific and sound reasons for the changes...your very personal situation really doesnt need to be ranted about, maybe not even mention it at all in the petition..let the facts/laws that other states use help you and cite what a success Floridas program has been...also hand deliver your petition to the individuals and calmly explain your views...I have found that they (my Pa state Rep who has an office about 40 miles away) are more than willing to spend a few minutes with someone who is being calm and sincere...It will definately take more that one trip to those offices to talk to and get your point across to the individual, and it will without a doubt take some time to get any changes made, but with the "right " kind of petition and action, you may make a difference...also just curious, but where were you whem the initial legislation was being passed? Did you voice yourself then or did you just watch everything happing around you? Were you involved then? Many people get upset after the axe has dropped, but did nothing to help prevent it in the first place...I am well ahead of the situaltion here in Pa, trying to prevent an all out ban, which will without a doubt come, if we dont do something to prevent it...changing law after the fact is much more difficult than helping to shape it in the first place...
So thats just my thoughts...I suggest you change your petition and offer some alternatives to the current legislation, and cool headed wording will help alot...then I will be more that happy to not only sign it but to try to get you a few more signatures as well....
Sierra

eXCELLENT FEEDBACK. tHIS IS THE KIND OF INFO I NEED TO PULL THIS OFF. I had no idea how to go about doing this because i never did anything like this. after talking to Bill i realized that it probably does sound bad. I am horrible with putting things on paper.Because i know what im talking about as far as my situation, trying to explain it to everyone else was very difficult and apparently came across wrong. If i could get with you via email maybe you could help me out? This petition is about changing the laws to a permit system. The game wardens were very patient and helpful. They just enforce the laws. It's the law we need to change. I will get back with you this weekend if it is ok with you. You had some great suggestions. Thanks Dave
