I would not care of the fine if I'm saveing a beautiful animal from death. I have saved a Gopher Tortise from the road and I think I have the right to do so if I'm not collecting or hurting it. There should be no problem.

The Trooper said $5,000...just repeating what was said to me. I know for sure that getting caught poaching native desert plants carries fines up to $50,000.

"In Georgia A developer can not come anywhere near a gopher tortise. Weyerhaeuser can only harvest trees that are no closer the 12 ft from any tortise burrow. If other states had protection like that we would have something to be proud of."
Sadly, this may be the way the law is written but it is not the way the law is enforced. In St Marys, I watched several Gopher Tortoise burrows get bulldozed to build our new Super Walmart and our medical center and all of our newest medical offices. No matter what anyone tells you, money talks and critters don't vote.
On the other hand, I have yet to meet an officer that would ticket someone for helping a tortoise crossing the road. Please note that "helping a tortoise to cross the road" does NOT involve the tortoise ever being in your car or trunk.
