Road Cruising - Illegal??

First off, BIG thanks to Mike Applegate, I think he's the closest one to me that can help me out w/ my atrox request. Many thanks to everyone else who offered! Now my question, in Texas, the law states:
"It is against the law to hunt any animal or bird from a vehicle on any public road or road right-of-way..."
and "Hunt" is defined as:
"To capture, trap, take, or kill, and includes any attempt to capture, trap, take, or kill."
Does that mean road cruising is illegal? Is it this way in other states? I was talking to my father about heading out to do this tonight, and he referred me to the "Outdoor Annual" from the parks & wildlife dept.
Does anyone have any ideas or facts on this?

Anyone else in Texas may want to look at this website too.
To my surprise; Yes, you at least need a TX hunting permit to catch snakes and many other reptile species. It does not say anything about the means used to catch them but I'd bet my lungs that you would get a ticket if they caught you road crusin...

Yeah, I don't "hunt" enough to need a hunting license, but I got one for huntin' snakes, because that's something I do several times a week. Thanks for your input, I guess road-cruising will have to be saved for other trips.

Don't take my word for this, check with the local game people for thier enterpretation, but here's my thoughts. Lots of states have laws with language like that, and the nominal reason for it is to keep people from driving around shooting from thier cars or standing in the road and shooting while other cars may be passing. If you're worried about getting busted on a technicality that is clearly outside the intention of the law, when you see something, pull over, get out of your car, and wait for it to crawl off the road...

Upon calling the TPWA, I was told by a "never to be naimed employee" that I interpreted the law right, it's technically illegal, but, like you said, it was mainly aimed at people spotlighting and hunting deer from their cars. This person said not to worry about it, as long as I'm not interrupting traffic or on private land. Yay!

It all depends on who pulls you over. Road hunting is illegal, even for snakes, in Texas. You can park your car and walk the road cuts and shoulders, berms and such. Some of the backroads aren't so bad as they are very desolate here in Texas and you're lucky to see one car every three hours. Scooting a snake or two off the road to keep them from being flattened is not that much or a concern. (Personally I don't collect, just go to look). Now areas like Juno Road where every flocks to search for the elusive grey-bands is a little different. Many collectors cruise the road cuts with the spot lights blaring, and this is very much illegal in the eyes of the law. Simply driving down the road from point A to point B may not always constitute hunting, but fire up a spotlight and you certainly have crossed that line. And yes, a hunting license in required for collecting here. Texas has become the "go to" place for herpers and Parks and Wildlife had to put some restrictions in place to counter some of the influx of collectors.

There is a thread on kingsnake.com about this. I guess there is a new interpretation of the law. In Texas, you do need permit, but road cruising is not considered "hunting from a vehicle".

Wish I would have known taht before I wnet out "road looking" tonight. 23 baby wdb's about 8-12" long, no rattle yet, and 1 adult around 4'. 18 of the babies were alive, but sadly 5 were DOA. The roads out here were CRAWLING with them! I did take a TON of pictures and video though!

I am glad I live in Georgia. Where it is not illegal. Also they don't care as long as you are not bothering any other drivers. Most of the people here will try to kill them. I try to save and catch them.
