Ricky, I personally know you. I posted the main question to find out if this was BS? Newspaper articles are something I never believe a word of. I hope you get through this alright and keep your wits about you. Alabama. I have some ideas of how this thing is going. In the olden days they called them "witch hunts". Sorry this has happened to you and Brad. As far as the permitting, I would demand to see who has permits isssued. Do you have an application? I would love to see it.

Thanks for clearing that up, I was actually referring to our ( american citizens) rights being slowly removed. Reptiles,and our ability to keep them, are only one aspect of our freedoms being taken.

there isn't a permit system, period. they SAY they USED to issue exotic venomous, but before they banned exotics due to an incident in moody, there was nothing in place and that's why a 16 year old had a spitter in a cardboard box that got out. i'm all for regulation, but banning this or that does nothing. i was told that before 2001 they issued exotic permits but that's when they banned exotics and before 2001, you needed nothing. they also said that it was NOT for public safety but for disease control. of course, in the papers, it's all about public safety lol. i asked them about the lax regulations on exotic NON VENOMOUS snakes that most definitely carry diseases, and the lizards and monitors, the birds, and the only regulated mammals that aren't native to alabama are the mongoose, nutria and a few fish. you can legally own a wild caught, disease ridden exotic mammal.
it's not about public safety, it's not about disease control, and it's not about anything except half-ass enforcing a law that is on the books due to localized public outcry and people wanting to be re-elected. as usual, it's politics. if public safety was an issue, they'd regulate the native venomous snakes but they don't.
as far as remaining silent, i know what can be used against me and i'll avoid that. there is really nothing to hide though. there was no secret to be kept

A fellow Herper and I have talked to 5 Management Wardens, and all of these Officers have told us that Herping on Swan Creek is not a problem. I guess these little Twits did not know what the Hell they were talking about.
It’s funny how the Dimwits that are in charge of Policing these Areas “As They Say In The Regulations That I Finally Found A Copy Of “ don’t even know the Laws they are in Charge of Enforcing. Guess that’s what we get for living in the most “Bassakerd” (This Means Truly Backward For Those Of You That Ain’t From The South) State you could ask for Huuu?
Ricky, I appreciate the warning and will take it to heart.

i was told that repositioning them with my hook constitutes an offense and that "if i'm caught with a snake on any part of the wildlife refuge, i'll be in more trouble".
this came from chris s. champion who is an officer for morgan county (decatur).

this is the problem, depending on who you talk to, the laws are this way or that way. they can't enforce some of them and then leave some up to whomever is around at the time. technically, in alabama black and white kids are still NOT allowed to go to the same schools and they chose to NOT abolish this law from the books in the late 90's/early 2000's, so obviously, they even want to leave that law up to "interpretation" like the state is doing with most of its fish and game related laws.
i like to take pictures on the refuge near blackwell, but if i'm caught with a hook and then treated like a criminal AGAIN, what am i supposed to do?
they like to be all gun-ho about things, but they have no clue what is going on and simply wanna make news. this is why they prepared a statement, sensationalized it and sent it to all the media outlets.

I won't comment on this particular case. But for those following this thread... if you don't violate the law you won't have a problem. If you are operating in a gray area you may want to consider whether it is truely worth the risk. I have strong relationships with our state agencies because they know I am a person of integrity that operates within the confines of the law. They call me as an expert when there are questions. Work with these people and develop cooperative relationships. If you are at odds with these people don't be suprised if they take the first opportunity to shut you down. To be a going concern you must be completely above board and be working at a high level of sophistication. Be a professional and develope professional relationships. You will be rewarded with consideration and respect.

but in REAL LIFE, people do what is best for them. brad hudson has done many things for alabama fish and game and everything was on the up and up, and then they decide he's a bad person.
hell, i helped him with a venomous display at the archaeofest in september at bankhead national forest (done for free and had been for years, fish and game were there)and the SAME things they knew then are all of a sudden a public risk or disease risk (as they told me). they'll tell you that false water cobras are OK to sell at a birmingham show, then they'll arrest you when you take it home. their form of euthanization is also barbaric.
so no, being "on the up and up" only forces them to try harder to make a story.
the bottom line is that they WILL make a story and that they know some people had rather pay a $500 fine than pay for a $1000 attorney.
and on top of this, why aren't sheriffs being investigated for giving out permits that are no good?
there is a lot that is NOT on the "up and up" and no matter whose ass you kiss, you'll be treated just like they feel like treating you

and can you explain the reason they chose to wield loaded shot guns around children to make a snake bust at a man's house they'd been to years before? there was no reason at all to assume a loaded shotgun was even a remote necessity. how come the federal game warden "had a vested interest in venomous reptiles"? he was there because they said he wanted to be there. i'd bet he took a few of these superb specimens home.
there is all types of BS that is going on. i'm fully expecting to be accused of shipping illegally even though i shipped via IATA regulations via northwest air cargo, which is as legal as delta dash. at the least, they'll force me to get an attorney to defend myself and spend a ton of money. there is no "up and up" to this state. it's who you know, what you own and how redneck you are.

As you probably know, there is a Flood Dike on Swan Creek Management Area that rarely if ever sees the foot of man except when Duck Season is in swing. Well, I have spent a lot of my time in this area taking pictures of Cottonmouth I find there and I have to say, it is one of the most populated Cottonmouth areas I know of. Now, I did carry a Hook with me for a wile when I would go there to reposition the Snakes I found, but now, I guess that has come to an end.
On another note:
I have seen so many people that are fishing, Mutilate or Kill Snakes on the Management Area and I don’t see any of these people being prosecuted for their deeds. But hay, if one of us that just want to take Pictures of these Gorgeous Reptiles even touches one with a Hook, we will get the Book Thrown At Us. Ricky, you probably know that some of the Management Area here still holds a somewhat good population of Eastern Hognosed Snakes (I see 6-7 a year on average) and I know these are State Wide Protected Species. But guess what? I see so many of these Snakes laying Dead near Fishing Holes and as proof of what happened to them, their Heads are Missing. You don’t have to be a Rocket Scientist to figure out that they lost their Heads to a Sharp Blade.
It is truly SICK how this State has laid their Laws out, is it not?

well "good ole boys" don't know no better, shoot, they're just trying to fish and drink some beer (also illegal but people who fish on the refuge usually have some beer too).
the problem is that "good ole boys" make up the fish and game department, not competent, educated, respectable adults.
